Oyster card non transferable + MG11

I just overheard a passenger being told by an RPI he was being reported for non payment of fare.

The passenger had not touched in on the Oyster PAYG, and admitted it belonged to his partner.

The RPI seemed to be saying a penalty fare would have been issued were it not for the fact it was someone's else card. Is it true that this should make a difference?

I appreciate that the passenger should certainly have touched in

This was on a train not tube
The MG11 was mentioned by the RPI to his supervisor by phone

Depends - pay as you go are transferable. Any kind of season is not.

Nor are cards with railcards loaded.

Sounds a bit odd, it is explicitly made clear that PAYG is transfersable, and unless travelling out of zone a Travelcard wouldn't have to be touched in. I wouldn't be suprised if the RPI thought something was rum when the passenger admitted it wasn't theirs, and changed their mind about the PF.
