I work for an agency who should be paying me more money under the new AWR rules, but they seem to have forgotten. Before i remind them i need to get my facts in order so have spoken to ACAS and Citizens Advice, both say i should get more and if agency don't give me any more work i would have a claim off constructive dismissal.
What i would like to no has anyone done this,i like my job and was told they would still have to keep me on and send me to same company is this correct.

I am not sure that you can claim unfair or consructive dismissal against an Agency until you have worked for them for 2 years...

AFAIK, it's 1 year on the same placement. After that your treated as a "core worker" which gives you equal rights to those employees who work directly for the company.

I can only go on from what I've seen but agency staff who work at our place have to be with us for over 12 months before being entitled to the same benefits/conditions as direct employees.

Warning to all: Don't tick off the agency or your in-direct employee unnecessary as they can make your life legally hell. Tread carefully.
