I have previously been stopped when exiting a station because I tapped out incorrectly due to card clash , on that instance I payed an out of court settlement of £300.

However I have a court summon for a different case in February I was rushing I had £2.80 on my card 16+ at Greenford station train was coming so I tapped and squeezed through the barrier because I thought I tapped it correctly and it took my money , so I squeezed through and the revenue inspector was watching me , I explained that I was going to hospital and I had sufficient amount on my card to travel 2 stops.

Anyway I've got s court summon which is stressing me out .

It's under offence BYELAW 17 - no person shall enter a compulsory ticket area without valid ticket.

I tried getting an out of court settlement but it's my second time and they rejected my offer of £500.

To put simply I want to become a teacher in future will this effect me , will it turn up on the CRB checks ?

Because I know teaching kids they do enhanced checks
I know it was a stupid mistake but it happend and would really want some information on this.

It definitely won't show up on a standard DBS check, and I don't believe it will show up on an enhanced check as it is a non-recordable prosecution, and in any case isn't relevant to working with children.

I believe it's only first offence that you can offer an out of court settlement, no chance of an out of court settlement for a second offence the TOC will pursue it to court

Advice 1: learn from your mistakes.
Advice 2: learn from your mistakes.
Advice 3: go to Court, by very apologetic and contrite and hope that the Magistrates are feeling lenient.
Advice 4: learn from your mistakes.

One question that might be relevant to the OP is: is that 16+ valid?

That other thread says end of last April they were 18. As I understand it, 16+ is available to those who are under 18 on 31 Aug, which only would have left less than a 4 mth window for renewal, as they must be 19 now.

Possibly worth enquiring as that might possibly affect things if it's not?

Both times he squeezed through the gate. I can see why TfL want to prosecute.

According to the previous thread, before that there was also a Underground 'problem':

Seems like you were expecting a Penalty Fare. Has this happenned before?

On the underground yeah and yeah I did have 60p on my oyster

(Link if need be: http://www.railforums.co.uk/showthread.php?t=99951)

So am I right in thinking that this is the 3rd dispute, (2nd one posted on the forum)?

Technically, there is nothing stopping a TOC accepting a settlement any number of times. In practice, they are much more likely to prosecute on a second (or later) offence.

  • It's unlikely that this will have implications for your employment.
  • It sounds to me like you'll be able to afford the fine.
  • It also sounds to me like you'd be able to afford train tickets...

This confusion arose in that thread but the OP said it was just one occasion.

Fair enough - I did think that 3 times was taking the mick and verging on unbelievable, but considering the amount of law students we have rocking up in this part of the forum then anything can happen ;)

Yeah I know it's my second time ...

First time I paid an out of court settlement

And yes you guys were helpful on both occasions

Do you guys think i should go to court ? Or just plea guilty via paper ? Because aslong as it doesn't effect my future e.g going to USA , coming up on my CRB check I wouldn't mind because it's cheaper £150 for the court payment it says on the letter .

Thanks

I don't see that you have any defence so my suggestion (bearing in mind that I'm not a lawyer) is to plead guilty.

Sorry to be pedantic but if you're going to be a teacher could you please learn the difference between effect and affect?

If he's going to be a teacher I'd settle for him learning the difference between right and wrong...

I will comment on the £150 reference – this is one of a number of amounts you would need to pay if convicted in court. You would also potentially need to pay a fine. And there is a victim surcharge, and possibly a fourth kind of payment that isn't coming to mind right now.

Did you have a valid ticket loaded on your Oyster card at the time you attempted to travel?

As far as the spelling errors etc are concerned this isn't a marked and graded website ,

well someone told me if convicted on byelaws it doesn't get put on your CRB

Also I had £2.80 on the card it cost 0.75£ on 16+ oyster as soon as the officer let me go I tapped in and left I didn't top it up because there was sufficient amount.

Anyway thanks all even the guys who like to bring my integrity into it

Dependent on where he lives, the OP may find his case reported in local newspapers. One of my local weekly free papers includes a section reporting all penalties imposed by the local magistrates - and this will almost certainly register in an on-line search for the offender's name.

In fairness to those guys, it seems to be your own behaviour at ticket barriers that has brought your integrity into question.
