Fare Evasion 4 times

I was on way home from Fenchurch street I didn't buy a ticket,

I was stopped by two revenue protection officers. Who said this is fourth time and filled in a mg11 form and that was it.

I still haven't recieved anything two months down the line, I have now moved address went back to old address still no letter.

I have called British transport police as I initially thought it was undercover, but they called and confirmed they have no records. I have tried contacting c2c but the customer services number advised they can't help. There is no way contact number for fare evasion for c2c, as I want to find out what is happening, surely they haven't forgot about me .... I know that for sure that they haven't.

I don't know what to do ....

They have up to six months to "lay information" before the Court, so you're not out of the woods yet...

How did you get through the barriers at Fenchurch Street without a ticket? They've always been closed whenever I've travelled through.

You could write a letter or email to C2C briefly explaining what happened and letting them know of your new address, to simplify the process of keeping in touch with them.

To the OP, you should continue to wait, and check your mail on a regular basis. If you are issued with a court summons and miss it, you will end up with a fine of £500+.

There is of course the possibility that the train company hasn't got round to processing the details yet so I wouldn't count on getting away with it just because you haven't heard anything.

If this actually is the fourth time you've been caught without a ticket then I would be very surprised if they do not initiate a prosecution, and you should gratefully and immediately accept any offer they make to dispose of the matter out of court. A court conviction will be far more costly than settling the matter administratively with them.

We are not c2c.

Yes, we have staff who work for c2c who post on this forum, but they are not going to answer for the Company!

However if you are asking for a prediction as to whether or not they'd agree to an out of court settlement, my prediction is no, not if you've been caught four times.

But, who knows, if their prosecutions department is particularly busy and you're prepared to pay a substantial amount, I don't know what they'll decide.

This is a very good idea, and would help with any stat Dec you may need to swear as a result of....

No need for the dole money comment mate. Most people I have come across fare dodging earn money. When I was unfortunately on the dole the year before last I didn't need to get the train anywhere and when I did the DWP paid for it.

It was meant as a light hearted comment. I myself was on the dole for a couple of months before I picked up a customer service job. But the bit I've emboldened - can't argue with that - look at the businessman caught down south with £40k of unpaid fares racked up!

He's had 3 opportunities to learn the lesson so far, but seems not to be able to understand that you need to buy a ticket when traveling on trains.

I, for one, do not wish to pay for his journeys.

To be honest I doubt a criminal record is going to mean much to someone who has been caught fare-dodging repeatedly but still does not learn. Unless there were some underlying mental condition which meant that the OP experiences difficulties controlling his own behaviour, I can only guess that there was no desire to learn from the last few incidents where he was caught fare-dodging. I really hope that he could prove me wrong, but I am not the least bit confident.

Financially I also don't know whether it would be better off for the OP to settle out of court either, as I imagine the TOC would want a very hefty sum for a serial offender.

I rather think that jail may be a small deterrent, if any were at all.

I really don't know what to say in addition to what everyone else has said. Normally I would say to really beg for forgiveness but with this being the fourth offence, all bets are off.

So worst case scenario jail or a hefty fine and conviction...best case settle out of court , ensure I pay for a ticket no matter what and that's that! And learn from my Mistakes..

Mistakes? This looks more like a case of serial fare evasion, and in that case it is a matter of changing your behaviour completely as you know full well what you are doing.

According to the OP, the RPI said it was the fourth time. If it was the fourth time with that RPI, it would suggest there have been more occasions with others.

After all at this point he has received no communication whatever and c2c have been no help, although if he can prove he initiated the contact there (should he be found) that would surely indicate a willingness to own up and face the consequences and for someone WHO DOESN'T ADMIT TO BEING ON RAILFORUMS (HINT,HINT) there is no reason he should sit around for six months waiting for a prosecution which might or might not happen. Needless to say he should not offer any further personal details on this forum.

Obviously this would be very bad advice should he receive any notice of prosecution in the interim and thus has an obligation to appear at court.

Well, that's what I wondered - if he has no notice of any impending prosecution, has contacted the TOC to no avail and has left it two months with nothing arising from the mg11 might it not be a reasonable assumption for someone unversed in the machinations of the rail industry/court system that they have decided not to prosecute and move? People are forever moving across London, after all. And young people often have a light lifestyle and don't require forwarding addresses.

Or is there anything on an mg11, which I understand to be merely a witness statement, which would countenance that?

That wouldn't stop the case going forward though... They would just be found guilty in their absence. And then it would go from there.

They would get found guilty in their absence, not pay the Court imposed fine, that would then be sold on to a debt collection agency (with added fees), the collection agency would track them down eventually and would then get their money one way or another.

So yes brilliant 'advice'! :roll:

Well you are perhaps taking the proverbial a bit if this is the fourth time you've been caught:roll:

However if I were in your shoes right now I'd be inclined to do nothing and keep quiet about it, you may have got away with it and if they do follow it up and the person at your old address RTS's any letters that may arrive there for you that will probably be the end of it.

I'm in no way condoning what you've done of course:cry:
