Hello all,

I have already been interviewed under caution and am not trying to get out of it. Its probably an open and shut case for the TOC or BTP.

However, should i still write a letter to the TOC Prosecution manager that interviewed me to try and settle out of court as a a court conviction and criminal record will destroy my career meaning losing my home and, without a job, it will mean it takes forever to repay the TOC?

Or should I get a solicitor to write the letter?

I cant afford a big solicitor - can anyone recommend a pro bono or 'free advice' solicitor experienced in train fare stuff?

While I don't know for sure, I'm pretty certain that is not the case. There are very, very few professions where a conviction under the Byelaws (or even the Regulation of Railways Act) would mean an instant end to your career. While it would be a bit of a black mark, if you are honest about it and don't try to hide it then many employers will look past it.

For the initial dealings with the TOC you don't need a specialist lawyer as any solicitor with experience dealing with criminal cases will understand the procedures involved.

hi,

yes, it is linked to that thread.

I didnt know whether to wait to hear from the TOC/BTP or write a letter straightaway repeating my apology, mitigating circumstances etc.

Should i also instantly offer a £ amount or just initially ask if they would consider an offer first then negotiate a £ later?

P.s I work in financial services but only in a junior role - no fat cat bonuses for me.
