No, the VIRMs are not compliant. As the life span of those units exceeds the date where all units should comply with the regulations, an exception to the regulations has been made for those trains alone.
The DD-AR and DDM1 trains will be retired next year, alongside with the class 1700 locomotives.
With the delivery of the new sprinter trains (SNG, Sprinter Next Generation, build by CAF), those trains are, indeed, no longer deemed as necessary.
SNG will enter into official service from this Sundays timetable change, but we have been running revenue earning trains with them as a test between The Hague and Haarlem for the past weeks.
The units are pretty reliable already in my experience. Only a handful of issues has been raised, but nothing too serious.
It'll be very interesting to see how things will turn out this Sunday, when all Sprinter trains between Haarlem and Leiden (and on weekdays between Haarlen - Leiden - The Hague) will be replaced with the new SNGs.
