Penalty Fare - Not asked to pay

Hi,

Just looking for some advice:

I was (correctly/fairly) written up for travelling in a First Class zone without a valid ticket - I was rushed on my commute and was being lazy finding a seat!

I travelled from Clapham Junction to London Victoria, which means the penalty fair is either 2x£5.20 or £20 - obviously £20.

I was cooperative with the Southern Revenue person and gave him my details. He then asked if I had the assets to pay the fare, to which I said yes. At no point did he ask for this money.

At this point, the train had pulled into Lonond Victoria whilst he was still filling out the notice. He then asked me to sign it without giving me a chance to read it (as the train was in the station he wanted to get off). In hindsight I should have taken my time and read it properly.

As I have not paid the penalty fare right there and then, does it immediately get escalated a more severe fine/prosecution? Would I get a penalty fare notice through for £20 in the post?

Any advice would be greatly appreciated.

Some services on that line are declassified, can you confirm which service you were on please so we can confirm the penalty fare was issued correctly.

It was between 9:27 and 9:31 or so from Clapham. They come thick and fast and I didn't take note of exactly which one I got.

I don't believe the train was declassified - if it was the Revenue Protection Inspector was majorly pulling my leg.

What platform did you board at Clapham if it was 13 hen it was most probably a mainline service and these are normally classified. If it was platform 15 then these a normally metro trains and are declassified

I boarded at 12 - I'm not questioning whether the train was classified or not, mainly whether the lack of asking for a penalty fare means a Fine/Prosecution.

Sorry my error I got the platform numbers mixed up odds go south evens go to Victoria my error.

Sounds like you boarded a mainline service which means it was classified first class.

It really depends. Did the inspector not inform you of anything before you left IE that he/she was taking it further etc etc. It does seem strange. If he/she has taking your details then more than likely you will hear from them through the post as in other threads, so imagine it will be the same ie you may hear from them from anything between a week up until 6months. Others with more experience will most probably be able to advice better than me so I won’t go into to much detail. Don’t let it worry you though you can’t change what has already happened when/if you hear from them deal with it then would be the best advice I could give though

Do you have a standard class season ticket covering this journey or did you show another type of valid standard class ticket?
Were you handed any paperwork at the time? If so does that say it's a Penalty Fare?
(It's possible, particularly if you showed a season ticket, that your details were taken for further investigation with a view to potential prosecution rather than being issued with a Penalty Fare.)

Just two questions please

1. You say 'I was correctly written-up', but are you certain that a Penalty Fare Notice was made out?

2. Are you a Standard Class season ticket holder?
