A train operator has been fined £1 million for the death of a passenger

I have just come across this article and there are a lot of comments online saying that the operator shouldn't have been fined as it was the fault of the passenger. Does anyone have any more background ie did this person really put his head out the window . I thought that the window opening is very high up and doesn't open fully so i find it hard to imagine how this happened
