Caught using friend's freedom pass

Hi. Can you help with advice. I was using my friend oyster card (he had freedom pass). The revenues they caught with after the barries. I know I'm stupid using that card.
What's can happened after investigation. They told me the letter will be at my home in next 2weeks.
What's happend with me and my friend do we gonna have criminal record. Are we gonna lose our jobs etc? Anything you know what's can happened please text

Do you know which train company the inspectors were from (or was it London Underground or TfL)? Or else whereabouts did this happen?

It was in the tube. I don't know the inspector was tfl or London underground. I panicked. He wasn't with me. The pass was confiscated by the inspector

First of all, you will need to have a "difficult" conversation with your friend. I'm sure he or she is going to be very impressed !

The experts will be along soon but using somebody else's freedom pass is fraud and you may go to court

What is your job?

I'm working at the station I have my own passes but different one. I know it's fraud. Do you think what can happen later. I know fine. Can we go jail? Or have criminal record? Can we lose our jobs?

As this is TfL, I think there is a strong possibility that you will be prosecuted. This will mean a fine and a criminal conviction if they are successful - and they are likely to be successful.

You didn't answer my previous question. You say you're working at the station. Doing what exactly?

If you go to court and are prosecuted, yes, you could lose your job and may have difficulty finding another one. It depends what line of work you are in

Unlikely but you'll get a criminal record
And my friend lose his job?
No. It's not your friend's fault that you stole used his freedom pass. I doubt your friend gave you permission

I’m working with train company. Host on board. It’s anything I can do to not lose my job an my friend don’t lose his jobs

Welcome to the forum. In my opinion unless your friend also fare dodged or used an incorrect pass I doubt he will be greatly penalised even if he let you use his pass on purpose. But I cannot say for sure.

At the moment, we have no idea. You will have to wait for a letter from whoever handles prosecutions for Transport for London.

Have you done this before? Be honest

If you have used his card a few times then it's even more likely you will go to court and get a criminal record

I don't think writing a letter to TfL is a good idea, they have you bang to rights. What would you tell them? "I'm sorry, I used my friend's freedom pass a few times and I promise I won't use it again" I don't think they would believe you

I don’t want write about “cancel the case”. I was thinking apologise and explain why I was doing that and ask for not really bad punish.

Just to clarify were you using his Freedom Pass or and Oyster Card that he may also hold?
The Freedom Card is exactly as others have said if it is an Oyster then it may be different.

No. Jail is almost impossibly unlikely for a first offence.

No. Wait until you hear from TfL. They may ask you to write or may ask you to attend a voluntary interview. Writing now is unlikely to bring any benefits and, without a case number to reference, may not get to those handling your case.

I’m not sure about freedom passes (which I believe are issued by local councils to residents over a certain age, possibly 66 now), but oyster cards have a journey history for at least 28 days (and probably lot longer stored offline)

If they do have plenty of history, then you are going to have a lot of explaining to do. Potentially the card owner will have to advise regarding if knew pass was taken / stolen / being lent to someone. And as some of these are against rules, they would have to accept consequences

There is no such thing as a free Oyster card (there are various cards like 60+, or zip, apprentice or veterans cards, but they all carry a photo of the holder). Exactly what sort of card were you using as you have changed it’s name in different answers

That's different to a freedom pass, and makes it a whole lot worse for your friend. Lending your pass out is a disciplinary offence, and quite a major one at that.

This is very likely unfortunately to end quite badly then, for both of you. Plenty of cases here where partners / spouses who have been have been given travel passes and misused them has led to gross misconduct and termination of employment. Misuse of your (his) own pass will be seen in an even worse light, especially if it was knowingly given to a friend.

Indeed - if your friend is in a union, they need to get advice ASAP.

Do you also work for TfL? Do you have a staff pass? If so, were you entitled to undertake the journey you took for free using your pass?

(I'm just trying to establish if there was a financial loss to TfL; if not, it might affect the outcome.)

They mentioned they were a on-train host earlier on, so likely a TOC with catering or similar.
