TfL usually prosecute offences like these, however, recently we have seen several examples of them only offering a final warning.
Lying (and being caught out) would destroy any chance of a warning or settlement.
Yes. The contracts etc for the work will already have been let so unless a new government is in place before work starts and they're willing to pay any penalties for cancelling/amending the work it will go ahead as planned.
I don't think we've ever seen a Penalty Fare appeal succeed for the stated reason that the wording on the signage was incorrect. Did you include any other grounds in your appeal? Is this the first appeal or a subsequent one?
Maybe I'm wrong, but particularly given that the card was misused by someone at the same address, they may feel that it's 'safer' to hand the pass over in person rather than post it to the address. Maybe with a verbal reminder of the conditions of the pass so the file can be endorsed...
If you're going to make a threat that everyone knows is hollow and won't be followed through with then there's no point making the threat in the first place!
