    TfL usually prosecute offences like these, however, recently we have seen several examples of them only offering a final warning. Lying (and being caught out) would destroy any chance of a warning or settlement.

    I don't think we've ever seen a Penalty Fare appeal succeed for the stated reason that the wording on the signage was incorrect. Did you include any other grounds in your appeal? Is this the first appeal or a subsequent one?

    Maybe I'm wrong, but particularly given that the card was misused by someone at the same address, they may feel that it's 'safer' to hand the pass over in person rather than post it to the address. Maybe with a verbal reminder of the conditions of the pass so the file can be endorsed...
