Delay Repay - based on 'next available service'

Morning, having a bit of an issue with GWR (surprisingly) over a delay repay claim - they are saying that Delay Repay is based on the 'next available service', so if a GWR train from Taunton arrives at Paddington 3 minutes before the last Elizabeth line train of the night to Woolwich, this is the next available service and this is what Delay Repay is calculated on, even though they know I didn't make that train. Malice or incompetence - who knows, but it strikes me as farcical. Expecting me to make a 3 minute connection from the mainline to Elizabeth downstairs, when the minimum connection time is 15 minutes. I have appealed again and asked for an 'appropriate' response. Let's see - will keep you posted.

It’s supposed to be the next available service accounting for the station connecting times. Did you tell them this?

Yes I did, in my appeal I said 22.41 to 22.44 is insufficient for the minimum connection time at Paddington, which as a Large interchange station is 15 minutes. I asked for an appropriate response. I'm not hopeful.
