Fined for no railcard

Hi all,

Last Friday I was stopped by revenue and fined £170 for having no railcard along with my ticket. My question I know SWR can check Trainline booking history but can they check Uber?

I’ve spoken to uber and apparently SWR cannot access any past bookings on uber Due to data protetction?

Has anyone been fined for no railcard who use uber to book trains? I’m happy to pay the fine for this fare but past fares would be a big issue.

@roachconno. Welcome to the forum. When you say you were "fined", were you actually issued with a 'Penalty Fare Notice'? Or something else? Either way, be useful if you could upload a pic/photo of whatever paperwork you've been issued with? Please be sure to obscure or cover up your name and address and ID reference number. Also, what was the journey you were making when you got stopped, start station, end station?

You should assume that they can check all purchases regardless of supplier. GDPR does not restrict data shared for the prevention or detection of crime, which is what such a request would be about. All retailers have to keep a record of transactions, so Uber will have the data available to share if asked.

(There is some debate on here about whether GDPR should cover data sharing agreements, but this is in regards to trawling the data and looking for suspicious activity - in this case, where they have caught someone in the act there is much more of a consensus that this is acceptable)

It should go without saying, but make sure you are always buying the correct ticket in future. Your details will now be known directly by SWR and they are unlikely to offer a penalty fare twice.

As discussed numerous times on here, this "crime" exemption does NOT cover railway company investigations - and it's rare for these things to be handed over to the police.

The data can only be shared in ways explicitly written into Uber's contract.

If Uber told you they don't share data with SWR then you should of course take their word for it. Or read the small print yourself and see.

For legal reasons or in the event of a claim or dispute

I don’t believe SWR have a sharing agreement with Uber. That said, I would suggest purchasing the correct tickets from now on. It’s possible in the future that all ticket sellers will have to share data.

Thanks for replying. I was issued with a penalty fare notice. But I’ve heard stories of SWR checking past booking which I have a fair few as my railcard expired a couple years ago. I know they gave a data sharing agreement with Trainline but I don’t think they do with uber? My journey was from Bournemouth to London Waterloo. The fine does say Poole to London Waterloo which is incorrect and my date of birth is wrong so I’ve appealed the penalty also on the grounds the journey is wrong. My main concern is if there able to check all my tickets on past bookings with uber.
