Issued MG11 Today on South Western Railway

Please I need a very urgent advise, today I got on a train going home, and I was about to miss the train and when I got to the gate I showed the Adecco staff who know me and he opened the gate for me so I quicky cathedral the train, but while In the train I tried to complete the transaction, but my network was so bad that I now finally change the page and forgot Until the train revenue guys came around.

While they asked me I panicked and lied to them that I got in from the station before I was caught, but the man kept asking me and I panicked again and told them the truth the actual train station I got in from.

So he got angry and issued me an MG11 form.

I am worried as I don't know what might be the outcome, could this lead to me been taken to court or give me a bad criminal record?

Although I asked him these two important questions and he said 9/10 don't leads as it is usual settled and that I might only be invited to state my side and get fined.

Although I don't believe him that much that's why I'm here to seek it advise and opinion. Please can someone help me with this information as regards what might possibly happen?

It could, and that is what their letter will say, but you should be able to avoid this.

Thos who engage with the train company are likely to be offered an out of court settlement.

He was being truthful, but we are here to help and advise.

you only need to wait for them to finish with their investigation and get back to you. I just got my out of court settlement letter today after sending 2 plea emails acknowledging my error in judgment and assuring them that it would never happen again. You only need to answer the question you are being asked and please come out clean. I pleaded for out of court settlement and they agreed.

From the advice which expert forum member @Hadders gives in cases such as this, adapted for your circumstances.

Travelling without a ticket is a criminal offence and SWR are entitled to prosecute you in the Magistrates Court if they want to. Generally speaking most Train Operating Companies are normally reasonable to deal with and will normally offer an out of court settlement in cases like this as long as you co-operate with them, and haven't come to their attention before.

What happens next is they will write to you saying they have received a report and are considering prosecuting you. This letter can take some weeks to arrive due to the number of cases in progress at any one point in time.

I suggest a short, concise reply that mentions:

- That you are sorry for what has happened
- What you have learned from the incident
- That you are keen to settle the matter without the need for court action
- Offer to pay the outstanding fare and the train company's administrative costs in dealing with the matter

If you are offered an out of court settlement expect to have to pay the outstanding fare at the full Anytime rate in addition to an admin fee, typically £150.

Paying a settlement might feel like paying a fine but technically it isn't. Only a court can impose a fine as a punishment upon conviction so you don't want to pay a fine, you want to pay a settlement!

When the letter from SWR arrives post a redacted copy of it in this thread, along with your draft reply, and forum members will proof read it for you.

Do not use AI to write the letter as such letters invariably sound insincere.

I have once been issued a fine on the train to pay within 21 days but it wasn’t and MG11, could this make my case a complex one for and could this previous mistake potentially make them decide not to give me the option of out of court settlement?

So it means I have come to their attention once but it wasn’t an MG11. But they might still have my record for that one I guess, because when the tax force man was typing my name, as soon as he typed my first name, he then went ahead to pronounce my surname I was shocked.

Unlikely to make them go for prosecution. We have seen significant fare evading still being settled out of court.

Going forward you must follow the rules as a third occurrence would be dealt with much more harshly.

If they find the previous occurrence, then they are likely to spend more admin time investigating, and might look at any history if you bought on an app or website (there won't be any history record if you normally buy for cash from ticket office or ticket vending machines)

If you follow the advice above, any offer will probably include a £150-200 administration fee for their time checking. The extra checking might also mean it is nearer 5-8 weeks before they will write to you, and of course any app history will include tickets up to date of checking (if they spot something odd they might ask about that too, but answer truthfully and don't volunteer information not asked).

Hello Team, please have done some studies because I have been so worried about the case, I just discovered that what I was issued is a Direct Report for Prosecution and not even and MG11.

I have just checked and discovered that an MG11 is different from that.

Mine is a direct report for prosecution, please how bad can this be for me being that I have been once issued an Unpaid Fair Notice in the train which I paid a week later.

Now I’m worried that this might come up to show I already have a history of such and I might not be pardoned.

This has thought me a huge lesson I just wish someone can help me explain if MG11 in the sense of Transport Evasion is same as Report for Prosecution.

An MG11 is a witness statement which means your case was reported for prosecution. Once the letter comes follow the advice in @Titfield’s post.

Try not to worry too much, not least because I would expect it to take quite a number of weeks before you hear from the train company (I didn't see the upload, now removed, so I don't know which company is involved). There are essentially three routes here - penalty fare, out of court settlement, prosecution in the magistrates court. I've no doubt that you were not offered a penalty fare due to your "previous" but equally I would still expect the train company to offer an out of court settlement in due course. All you can do is wait for the letter, assuming you gave the correct address. And keep some money back for the likely hefty bill from the train company. Those who don't engage get taken to court, as a general statement.
