I board a train on the 6th of December and traveled more than my return ticket, I tried buying a ticket to enable me travel but the network was bad while on transit before we passed the station on ticket and I got a call that distract my attention before the revenue protection team came and ask for the ticket. I bought the ticket and explained to him but he refused to listen and took my details. I have called west midland train to apologize and sent an email to customer relation to apologize because I have never been involved in such incident before. Last week I received a letter of intention to prosecute and I replied the letter apologizing for the action and stated I am willing to pay the necessary penalty fare west midland will send to me for my action and promise to ensure this never happens in the future. Please do you think I will prosecuted and this is the first time I am faced with this incident and I am thinking contacting a lawyer because I want out of court settlement. Out of anxiety and I wanted to reply back the same day I received the letter, I did not copy out the reference number, please any idea how I can get the reference number and IRCAS phone too will be highly appreciated.

Have you not still got the letter that you were sent? That will have the reference number on it.

At this stage if you have replied then there is nothing you can do until they respond. They will either offer an out of court settlement or tell you that they are going to prosecute you. If the latter then there is still an opportunity to reply again, as sometimes this can be effective. When you get the letter back from them, come back here, and post a copy of their response with all your personal details and the reference number obscured, and we can help you draft an appropriate reply.

@Brissle Girl thank you for your reply, I have gotten the first letter and replied back the same day and it was delivered the following day morning because I paid for signature on delivery so I can track the letter when is delivered. Once I get the second letter from them I will post it here like you have advised for assistance. Thank you for your response.

When you do that, please also help by telling us what journey you had paid for and what extra trip you decided to make (and why you waited till you were on the train before trying to buy the extra ticket).

Good morning @Brissle Girl and this forum your response. I called ITAL group this morning and I was given the reference, I used the reference number and postcode to check the status on IRCAS website and I saw I have been granted out of court settlement and a penalty fare of £182.80. I called the ITAL group back and the lady said I should go ahead and if I have the means of paying today, I have paid the penalty fare to keep my mind at rest. Thank you all and I will ensure this never happens again.
