MG11 statement

Hi there
I got today MG11 in station
I touch in Blackfriars station and get out in penge east so they check my oyster card and asking me for previous uncompleted journey so I panic and give them wrong details so what I should do now
The letter will be delivered to wrong adress
Do I need to ignore it or contact them
Please advice me

It’s much worse if you do not get the letter because they will take you to court and you can’t prevent that so you will get a criminal record.

All that can probably be avoided if you get the letter and respond to it.

Would i still pay it
After he left uk he give me oyster to use it
The oyster not registered with any name

Probably depends on if the type of Oyster card is permitted to be transferred to another person in that way.

Then on your ability to prove it was not you who used it incorrectly on those occasions.

So the letter can be included the penalty amount or they will request explanation about incident
No they won’t write to you asking for a penalty amount at first. They will ask you about what you have been doing.
Then they will consider what they think you may have evaded paying.

I can explain to them that I take oyster been used by other family member and I just take from him and he is no longer in uk

Would they charge me for card history

They will investigate the travel history.

If they check the card will they find your ‘relative’ travelled to and from the same stations as you, at roughly the same times and days throughout the week?

It will be quite obvious to them if you are lying.

Did you give them your correct name and date of birth or did you give them completely false details?

Then I suggest you contact the TOC that stopped you and provide them with your correct address (or make sure you can access the ‘wrong’ address to get the letters) - otherwise you’ll be convicted without receiving any of the paperwork and have no chance to avoid a conviction. Criminal record and unpaid court fine will probably cause you issues.

The main thing to bear in mind is not to continue lying about anything. They will look at the travel history and identify patterns of use of the Oyster card.

If you claim that someone else has been making identical journeys to you that fit your travel pattern, they’re unlikely to believe you. If someone else has really been using the card before you, the forum will be able to help you in how to respond to the TOC once you have their letter.

This is good advice in my view.

If it is required to convince the train company that someone else was the previous user of the card then that person may need to give a written statement, complete with their full name and address, stating this (and the train company might then pursue them for any money they believe is owed)

What I suspect has happened here is the original user of the Oyster card found a way to evade their fares by using the Oyster card in a particular way. They then passed the Oyster card onto the OP here who did the same thing to evade fares and has now been caught, and is now concerned the railway company will come after not only the OP's evasion, but the original holder of the Oyster cards evasion. If this is what I think it's possible that the railway company (who will get all the use records from the Oyster card and can thus look carefully at them) might think the same thing.

The OP needs to do two things now

- ensure they can get any letters sent to them so they can respond and request an out of court settlement in exchange for paying money owed
and
- start paying for the correct fare for every journey from this point on either with a new Oyster card used correctly, a correct paper ticket, or contactless used correctly
