Hi all,

As the title suggests I was stopped by an inspector in June who asked to see my railcard (which had expired). I gave my correct details and address and he said they'd be in touch. 4 months later, still no letter.

I haven't followed up on this, but occasionally anxiety sets in that it may have got lost in the post or something. Anyone here had a similar experience or can offer any advice as to what I should do?

Cheers!

I can only suggest that you wait as it may be that the inspector decided after the fact to let you off, or their notebook was mislaid, or the case has otherwise fallen through the cracks.

Once it reaches 6 months after the incident the prosecution deadline expires, though it would be wise to wait a few more weeks after that in case the paperwork was laid in time and the court takes a while to post it to you.

There is a small possibility that the notices may have been sent and not reached you leading to a conviction in your absence, but it's quite hard to find out proactively that that has happened.

Hi, thanks for your response. Yes I’m hoping for the former, although I recently had a DBs check done for a new job which didn’t show any convictions. Is there any other way I’d be able to check?

This would not be a conclusive way of checking.

I would not do anything, however, until after 6 months have passed. It is in your interests to say, and do, nothing at all.

Hi all,

As the title suggests I was stopped by an inspector 6 months ago while travelling with an expired railcard (see my previous post for details).

It's now been just over 6 months and I've not heard anything from GWR. Am I right in thinking their deadline has passed for prosecuting me? Or have I been misinformed?

Many thanks

Yes, the deadline for GWR to start a prosecution has passed - but there could still be something in the post for you, because the 6 month deadline is for the prosecutor (i.e. GWR) to notify the court, and the court then needs to notify you.

Practically speaking, wait until after the new year when the Christmas post should have cleared. If you haven't heard anything by maybe 4 January (the Saturday after New Year's Day) then you can be pretty certain that you're not going to hear anything.
