Hi

I am completing an application for train conductor role. DBS wise what checks are done for the role? Historically I have an offence spent but still showing on DBS for another two years. Unsure if I need to declare this at application stage?

It’s basic only, as with most railway roles, so that means your spent conviction won’t show up and there’s no requirement to mention it.

In fact you have a specific legal right not to declare spent convictions under the Rehabilitation of Offenders Act 1974, unless applying for one of the very limited number of roles to which that act does not apply, which doesn’t include front line railway work.

I think some do some don’t? I’m fairly sure my first TOC mentioned it on the trainee driver application. I have no idea whether it was actually carried out!

I had one for a job before I worked on the railway. I got a copy to my home address. I never had one since.

I just had to do one myself and post it to the company. The £23 will be in my first pay packet

Yeah its mentions unspent convictions. Mine are spent but will still show on DBS till 2024. Motor offences i was convicted. In a role currently that requires a DBS enhanced so shows it. Just was unsure whether to declare or not.

I can't speak for this particular employer, but broadly -

Employers can't just decide to ask all applicants for detail of spent convictions and / or do an enhanced DBS check - the role has to meet certain criteria.

It's usually for jobs involving being directly responsible for children / vulnerable people and so on, as in working in schools. Not (for example) shop staff who will occasionally have children as customers. I'm not sure whether train conductors are included.

Does the application form (or web page) specifically say the job is exempt from the rehabilitation of offenders act and ask you to include spent convictions? If it doesn't, then you are not obliged to disclose spent offences.

If the job is exempt, then in general, failing to declare something that they find out about later is more likely to count against you than disclosing it now.

Unless you're on the 'barred' bit of DBS, i.e. have been barred from working with children, then it's not DBS's role to say to employer 'you may not employ this person because they have a record', it's their role to provide info to potential employer to enable them to make a decision.

Unlock and / or NACRO may be able to offer specialised advice.

Frontline railway jobs such as mentioned in the OP aren’t exempt from the ROA, hence no need to disclose spent convictions.

Just was unsure whether to declare or not.

I'm about to do mine for commercial guard with SWR, can anyone tell me if it's the Basic DBS which for some reason shows as only being £17

I have no idea what the cost is, but surely you aren’t being asked to pay for it yourself? Especially if you’re an existing employee?

Most Network Rail jobs require a Baseline Personnel Security Standard (BPSS) check rather than a DBS check. It’s a little bit more in depth than a DBS check. A few roles need higher levels of clearance

Criminal records wise, it’s no more than a DBS check, which it incorporates. Additional checks on ID, employment history, migration status.

Basically a detailed reference + DBS.

I'm amazed people are having to sort this out themselves, every time I've needed one its been paid for and arranged by the employer.
