Its quite disturbing how many people are defending her on X TBH. We had quite a lot of whataboutery about this when Huw Edwards was sentenced as well (I think he should have got at least a 6-12 month custodial sentence BTW).

The courts implement the law. She pleaded guilty, and her lawyers accepted it was a category A case.

I'm not a lawyer, this document is from a 2018 consultation public order offences. It might not describes the precise rules that were used, but it gives an idea of the issues that were covered. The bold highlights are from the original document, not me.

The "Intention to incite serious violence" looks like it was a key factor.
This is from page 49 of the PDF file.
I know courts implement the law, so I am not sure what the point of your post was, if aimed at me.

Most of the people who think the sentence is too harsh are rarely so outspoken. I can imagine if the suspect was a Muslim man saying white people should be burned alive in their homes, turfed out of where they live and "if that makes me a racist, so be it" we wouldn't be getting so many of the usual suspects defending them. And it is always the same people, telling on themselves over and over again.

A person convicted and imprisoned for taking part in these far right protests has died in prison. It would be interesting to explore how someone, described a family man and "very caring", can be so completely consumed by obvious conspiracy nonsense to the extent they take part in riotous assemblies hoping to murder people.

I would love to see data on his social media exposure, which commentators he followed and what print media he was reading.

A grandfather convicted of violent disorder after taking part in rioting outside a hotel used to house asylum seekers has died in prison.

Peter Lynch, 61, was serving two years and eight months after he pleaded guilty to being part of the unrest at the Holiday Inn Express in Rotherham on 4 August.

He shouted "racist and provocative remarks" towards officers and called asylum seekers in the hotel "child killers", Sheffield Crown Court heard at his sentencing.

Whilst on the face of it the sentence may seem harsh, it has to be remembered that part of any justice system is to act as a deterrent to others.

I don't think it harsh in the slightest.
It was a ridiculous tweet but it was taken down and she apologised. She was rightly charged but 31 months for someone who has no previous convictions and has recently lost a child is way over the top.
None of that matters. Free speech is not consequence less speech. We all know that. There is a section of society who think that what they say on social media is in some way protected speech when it is not. This is a salutary reminder of that.

There was surely a better defence to what she did than what her team put before he court.
She pleaded guilty.
Oh, I'm not defending the rubbish that is posted by people on social media under the banner of the 'free speachers' but the government are bang in the middle of this because of comments made by the Starmer in the immediate aftermath of all the trouble.
No government of a civilised nation ( regardless of rosette) is going to allow simpletons to try and lynch people and burn buildings down. None. They are all going to come out with strong statements about rule of law, crack down, full force of the law, emergency courts etc etc. Cameron did the same thing in 2011.

It is a standard legal/establishment response in times of civil disorder: they will throw the bookcase at you if caught because if they don't then they cant get control of the situation and things could spiral out of control. Afterall, justice must be seen to be done!

EDIT - there is a woman up in court today for chucking a milkshake over Farage. She will get a harsh response because of the victim now being an MP. You cant have that sort of thing go on. Farage might be an odious sh*t but in our system he has the right to seek election and that needs to be protected. I dislike the man but he should be allowed to campaign with the same protections as anyone else.

*except when permitted by speaking under parliamentary priviledge in the house of Commons.

Counter productive too. Farage gets yet more media coverage for his ‘I’m a nice ordinary guy, honest’ facade.

I think there’s probably an exceptionally sad link to digital literacy and source interpretation that will differ from pre-digital generations, the digital generation, and post-digital.

You’d think so, but there were a lot of younger people also caught up in this as well.
