Hii everyone yesterday i just received a letter related with the prosecution and it is same as the case above. Anyone can tell when they will reply the mail because I don’t want be prosecuted and want to handle this matter out of the court

To avoid confusion we only ever discuss one case in each thread because experience has told us that no two cases are ever the same however similar they might seem at first.

Hello everyone , on 20 may 2025 i just received a notice of intended prosecution from chiltern railway. I was making journey from smethwick galton bridge to Birmingham moor street on march 28 and i failed to show a valid railcard for the journey . They have since looked at my ticket history and have noticed i may have avoided the correct rail fare on multiple occasions. Naively, i bought the cheaper ticket from smethwick galton bridge to Birmingham moor street a few times . Is this response okay to reply to their email with in order to receive just a fine at best?

"Dear Prosecutions Team,

I am writing in response to the Notice of Intended Prosecution I received relating to an incident that occurred on march 28 on a Chiltern Railways service, during which I failed to present a valid railcard when requested.

Firstly, I want to sincerely apologise for my actions and any inconvenience caused. I accept that I was in the wrong and that I did not pay the appropriate fare on that occasion. I take full responsibility for this and I deeply regret the incident and the pattern of behaviour that has been identified.

I now understand that my past travel history has been reviewed and that concerns have been raised about fare evasion. I would like to express how seriously I take this situation. This is not something I intended to escalate to this level, and I am genuinely remorseful.


I want to emphasise that my actions were not premeditated with the intent to defraud, but rather stemmed from poor judgment and a lack of understanding of the consequences. I understand now that this was unacceptable and appreciate the opportunity to provide an explanation before further action is taken.

If it is at all possible, I would be extremely grateful for the chance to settle this matter out of court by way of an administrative settlement. I am willing to pay any outstanding fares and reasonable costs incurred. I assure you that this will not happen again.

Thank you for considering my response. I am more than willing to cooperate fully to bring this matter to a close in a respectful and constructive way.

As i told that i have received this letter on 20 may 2025 and I don’t want to have court proceeding , i just want to settle this out of court. Please do help me and guide me what should i do as i mailed them and waiting for there response. I will pay all the outstanding fares and penalties

You've sent the mail already?

It could be improved (that talk about not being pre-meditated for instance and drop the word "reasonable!"), but as a general rule it should probably suffice.


Most cases are resolved by an out of court settlement.

It is usually several weeks, but there is no definite time. The only limit is six months if they wish to bring a prosecution - but if things are as you describe then that is unlikely.

There are a couple of sentences that should go. It clearly was premeditated with the intent to travel fraudulently, as you have done it multiple times, so why do you say it wasn’t? You need to be honest with yourself as well as them.

And as for “not intending to escalate to this level”, well you would hardly set about it with the intention of them threatening to prosecute you, would you?

If it’s possible if you can provide me any possible solutions to settle this out of court because right now i am very worried and helpless

Chiltern will almost certainly settle but it helps if your letter says the right sort of things. It on the right sort of lines but needs a bit of refinement.

I normally suggest these sort of letters mention:

- That you are sorry for what has happened
- What you have learned from the incident
- That you are keen to settle the matter without the need for court action
- Offer to pay the outstanding fare and the Chiltern's administrative costs in dealing with the matter

You'll find lots of examples you can use in other threads in this section of the forum.

Not at all. You need to do this if you forgot to attach your letter.
