SI 2021/907 makes rules about the LAPT and penalty fares thereon. They are in rather less detail than the corresponding provisions on National Rail. A few notable points:
- The Penalty Fare is set at £25
- If a Penalty Fare is paid on the spot in full the passenger is not required to give their name and address
- There is no requirement to pay at least the normal fare on the spot.
- The rules provide that where a passenger claims there were no ticketing facilities in operation at the start or end of their journey, the burden of proof is placed on the operator to prove that there were. Such a claim must be made within 21 days of the issuance of the Penalty Fare.
- Appealing a Penalty Fare will not remove the passenger’s liability to prosecution should the Penalty Fare remain unpaid, and a prosecution may be brought if a payment has been made out of time (subject to refunding the Penalty Fare).
