hi
I have been received email from wm trains for fraud.
I told them that I did not know anything because I am new to Uk
This is so stressful An anyone help pls

Hello today I received a mail from Travel fraud investigation and I don’t know what to reply can please help me.
We have recently been handed a file relating to an incident on 15 of April 2024 when staff were carrying out their revenue duties, you were asked to show your ticket, the ticket you offered had been purchased after departure contravening the conditions of carriage.

Further investigations into this matter have been carried out, including a review of the ticket records. It would appear, at this stage, that this may be a case of fraud. West Midlands Trains take travel fraud extremely seriously and is committed to prosecuting all cases of fare evasion to the full extent of the law. Travelling on the railway with the intent to avoid paying the full fare is an offence under the Regulation of Railways Act 1889. Such an offence carries a maximum fine of £1,000 and/or three months’ imprisonment and, in either case, a criminal record. It must also be considered whether this matter amounts to a much more serious offence under the Fraud Act 2006.

At this stage we would be grateful if you would provide any evidence to support the claim that none of the above legislation has been contravened to prevent further action being contemplated.

We look forward to hearing from you.
I have received same email when I booked a ticket for my friend. Now they saying you used two rail cards. I did not know anything because I came to Uk new

Your best option, both in terms of financials and in terms of your future and career, is unquestionably to pay the settlement with any legal means at your disposal.

While this is a very recent development we have started to see some cases of TOCs agreeing to a payment plan. This used to not be the case; you may consider asking them for such a plan, but don’t rely on it.

Ask friends, family, etc for any money you will be able to scrounge up, and speak to your student union rep, who should be able to offer confidential advice for these kinds of situations.

Again, a criminal conviction will nearly definitely not be cheaper even in the short term. If you are a student, they will assume you have income of £120 per week and calculate the fine based on that.

Situations like these are still resolvable, so stay calm - but you need to act quickly, and talk to the right people.
Does it actually lead to court etc? If we are replying then for everything and all?

Also should we write in email that we want to settle it out of court or no

Let's try and break this down into bits as bit confusing

1) Did you buy tickets for travel on 15th April
2) Did you travel (or was it someone else)
3) Was there just one person travelling or did both of you travel
4) If 2 or more travelling, did you each have a ticket (even if one person bought all the tickets)

Now part regarding railcard
5) Did you tick a railcard held (if so which one)
6) Does the person travelling hold that card (and not expired)
7) Do you have railcard, but friend doesn't

Now a question, on do you or your friend travel on rail regularly, or was this journey a one off
8) Do you have an account on train ticket site (web or app) or did you buy these tickets at station, or machine at station
9) Do you use rail regularly,
10) If travel often, was the journey on 15th April unusual (not your usual route)

11) Then we need to know if you or your friend was stopped by a ticket inspector
12) If stopped did they take details, or photo the ticket

Finally could there be something else you haven't said
13) Did you claim refund for tickets
14) You mention 2 emails, are there 2 accounts, or were they same

Another reason why it doesn't make sense is if you had only just arrived in UK, and only just opened an account, then there won't be any previous journeys logged, so seems like something else is wrong if received this email

It looks as though you have cut and pasted from someone else's thread in the forum. You will not get very good advice unless you explain what happened to you.
Read the information in the pinned thread
and provide the necessary information, including the letter or email which you have yourself received. Then there will be good advice as to what to do.
