Received letter of intended prosecution

I received a notice of intended prosecution what should I do know how should I explain everything in email.


I booked my ticket on 21 September and on 25 September I bought the railway card but again I did mistake to book the ticket what should I do know?? Please help me to get out from this situation

It was my husband who travelled on 25th of September from South Ruislip to Gerard cross and I bought the railway card on the same day but some how I did mistake to book the ticket and he was caught for not having the right ticket. Now we still have a rail card for family and friends I don’t no how to explain in the email which I have to send them back against NIP.

I checked my whole travel history the first ticket I made on 21st September at that time we didn’t have railcard and 2nd we made on 25 September 3rd we made on 1st October these 3 tickets I did wrong

Yess he was travelling alone and told the staff that my wife booked the ticket but they didn’t believe
thats Why the ticket wasn’t valid as he had a Friends and Famly Railcard he needed another person travelling with him to validate the ticket

To clarify, is the letter addressed to you or your husband?

If it’s to you, then you should simply respond that you did not travel on that ticket. You purchased it and gave it to someone else. The fact that they didn’t take your husbands details to write to him is their problem, not yours.

The railcard I have is on my name and we misunderstood that me and my husband both can travel on this card.
The other thing is that on 21st September my husband made first journey through train at that he had no railcard as he came to know that we need railcard to travel from South Ruislip to Gerard cross then I made the railcard on my name on 25th September and on the same day he traveled from South Ruislip to Gerard cross and he was caught by the inspector. Our major problem is that first ticket we booked was without railcard and the 2nd ticket that I booked for my husband was not meeting the criteria of my railcard that I had on that time and on 21st October I booked one more ticket that was not meeting the criteria of friends and family railcard.we just made three mistakes.

You've left your husband's name showing on the letter you posted. It would be good to cover that up to keep this anonymous for you.

Provided you are both named on the card, either or both of you can travel with the Railcard.
The problem is that you need to travel with a child under 16 to get the discount.
I am not sure how you managed to book without paying a child fare.

Anyway, your husband needs to reply and
- apologise for travelling without a valid ticket
- acknowledge that people not paying the correct fare costs the railways and the taxpayer a lot of money
- say that he now understands the railcard rules and promise not to make the same mistake again
- ask them if they would consider offering an out of court settlement for the fares he has underpaid.

If he engages with the company they will probably agree, but they will ask for the full fare for each journey (not just the difference) plus a sum (possibly around £150) for admin costs.

They’ve provided you with an email address, so that’s the easiest way. Make sure you quote reference number, and your name and address, so they can match your email reply to their records. And keep a copy of your reply.

Post #12 above sets out what you should say. If you write a draft and post it on here (removing persons details), then we’ll be able to help refine your draft. There are also plenty of other examples on this forum.

I am writing in response to the Notice of Intended Prosecution dated 25th January 2025 (which I received on 29 January 2025)about the incident (Ref: xxxx) on the 25th September 2024. I sincerely apologise for not having a valid ticket to board the train on the date of the incident, which was happened to me by lack of information as I purchased the friends & family railcard and Unfortunately I didn’t know that i could not travel through friends and family card.I was unaware of using rail card properly.After this mistake i got all the information about railcard and tickets and now I carefully book my ticket before starting my journey on the train station’s ticket counter.I took full responsibility for this happening.I genuinely regret my action and its impact on Chiltern Railway. I now realise how serious it is not to have a valid ticket before boarding and how unfair it is to other Chiltern Railway customers.

I have learnt my lesson with deep remorse. Also, I guarantee this will not happen again by using the railway card in accurate way and by having all the information before starting my journey.I am willing to cooperate fully and pay any fares I owe, plus the administration fees incurred from this incident. I would be extremely grateful if this could be settled out of court.

I'm replying partly so that your thread goes to the top of the forum. I think you edited in your comments about this being urgent rather than making a new post.

A couple of tiny points. You need to put the case reference number at the start of your letter; I put it as a separate line after Dear xxx. At the end put Yours sincerely if you have a person's name, otherwise put Yours faithfully.

I have sent an email of Apology to the chiltern railway on 5th Feb but I have received no reply yet should i wait for answer or send them an email again to inquire about answer?

No your case will just go to the bottom of the pile, they have literally 100's of these cases to get through so you'll just have to wait your turn. There is nothing to be gained by keeping in contact with them
