Possibly not, still trying to ascertain what the exact situation might have been, albeit this doesn't seem to be the easiest of threads in that particular regard.
If @mgut feels unable to share more info or answer here particular questions about what happened - I would suggest as I did up thread that they send a generic apology and request to see if the train company will offer an out of court settlement rather than court action and hope for the best / take it from there.
