I agree (with one caviat - if the passenger always purchases the excess at the destination if they're not challenged on route, there's no problem).
But if he/she just walks out at the destination with no intention of purchasing the excess, that's probably an offence.
No doubt DaveNewcastle will be along soon to tell me I'm wrong.
I'm not quite sure what should happen if there's no ticket inspection and the ticket office is closed at the destination though.
