Was I arrested?

Hi, I hope this is the right place to post this - please let me know if not.

A little while ago I was caught without a valid ticket and read my rights my the inspector waiting at the barrier. I was handed a slip which I was able to use as a ticket, which states that the person questioning me was a GTR employee. I was told I would receive a letter, which I have not yet.

My question is does this count as being arrested? I’ve recently read my employment contract which states that I must inform my employer if I am arrested or subsequently cautioned or convicted of any offence.

Obviously, I’d rather not reveal my current situation to my employer but I need to know if I have to (if what happens does indeed count as being ‘arrested’).

You would know if you'd been arrested, as it would have been made explicitly clear to you that were being placed under arrest.

No, this doesn't count as being arrested. In general, rail staff do not have any powers of arrest (any more than you or I do). They do have a power to detain you until the police arrive if you refuse to cooperate, but as you gave your details it wouldn't even appear that this was engaged.

You will likely receive a letter asking you for your version of events at which point we can give you further advice on how to proceed.

No, not arrested, nor subsequently cautioned, nor convicted.

However when letter comes it will ask for your version of events, they then might make you an offer (take it or leave it basis, not for negotiation). Either pay cash offer and close it, or risk going to court (where if you know you were in wrong, then would almost certainly lose and then likely to be convicted).

If you know you have been doing this multiple times, on big scale, and have an app / website buying history that shows it, there is a possibility that you will be asked to attend a meeting under caution, if that happened might need to disclose it to employer if they then caution you. But don't need to advise employer currently.

When you receive the letter you may want to update this thread with its contents and people will advise you on how to act on it - depending on what it says clearly so at the moment it's guesswork but there should be a strong possibility of resolving this without a conviction of a criminal offence.
