Hello guys

Please help as a matter of urgency.

Received a letter to explain the incident when I gave my details to the officer. I just wanted to ask. Can digital tickets be known when you scan in and scan out or it’s just applies to Tfl.

@Hadders/others - I had a valid digital ticket but didn’t scan in and doubled a traveler through the barrier just to quickly catch my train but when I got to my destination. The officer was able to check and saw I didn’t scan in but I explained I was in a hurry. He still took my info and now SE have sent the letter. How do I handle this

Did your exit station have gates that you needed to scan out of? What kind of ticket did you have?

If it's an Advance ticket, these cannot be refunded, so it's neither here nor there. If it's a more flexible ticket however, these can be refunded until they are scanned, either at a gate or by a guard/revenue inspector (On a separate note: Did people know that Trainline now shows 'This ticket cannot be refunded as it has been scanned' (wording may vary)), therefore it may have been possible for you to refund the ticket whist on the train.

In any case, I believe you may have violated the railway byelaw 9.2:
where the entrance to or exit from any platform or station is via a manned or an automatic ticket barrier no person shall enter or leave the station, except with permission from an authorised person, without passing through the barrier in the correct manner
Can you upload a copy of the letter you received with your personal info redacted

Train companies are not stupid.

You either;

1) travelled from further away and bought a ticket for a shorter journey to save money.

Or

2) don't scan your tickets so you can refund them.

If you want helpful advice then you need to be honest here. Yes, they can see where and when tickets are scanned. They will also check through your previously purchased online tickets and look for patterns of fraudulent travel.

We need to know:

What was your exact journey
What ticket did you use? You say it was a digital ticket but was it a ticket with a barcode? A smartcard? Or a flexi-season ticket?

Yes both exit and entry had gates

@whales. Welcome to the forum. Would you be so kind as to answer the questions asked by @Hadders in post #4.

Looks like you're dealing with South Eastern, rather than TfL.

The following thread is also relevant in your case...

Hello team, I got an out of court settlement and was given 21 days to pay. 21days wasn’t due and I received an SJPN letter to respond if I plead guilty or not .

I have paid the out of court settlement and I received a transaction reference and it read fully paid and case closed.

I thought since I was sent the SPJN letter .It would not accept payment but it did .

On the other hand, I was also given 21 days to respond to the SPJN letter. I am so confused . Guys please advise what to do?

Most likely, now you have paid the settlement offer that will be the end of the matter
But my suggestion - just in case - is to return the SJPN form. Leave the 'guilty' or 'not guilty' boxes blank, but in the space where you can put mitigation, explain that you have paid the settlement. Include the settlement reference and if possible send a copy of the payment receipt.

My thinking is that because you have returned something, the court won't treat this as failure to plead (and so an automatic guilty verdict). Rather, it will put the case in the 'someone needs to look at this' pile - and that someone should check with the railway whether they want to continue the prosecution.
