Whilst they might bring net custom to the industry, as the ORR judgement shows, it also brings more net cost than custom. Unfortunately, the OA takes the benefit of the custom, whilst the Government takes the hit on the cost.
Fault of the structure rather than fault of the operator I would say though?

If OA paid the same as the 'regular' operators....

Oh I quite agree. If I was Government (and I’m not), and had this one been approved, I’d have been legislating to change that part of the structure in short order.
