Help with Chiltern intention to prosecution

I was stopped by an inspector on August 16th 2024 at stoke mandeville to London Marylebone. I gave over my details and everything, then on the 4th October 2024 I receive a letter about a intention to prosecution letter. I emailed the day after receiving the letter, to which I get an automated reply saying it will take up to 30 days for a reply. It is now the 13th November and I have received nothing? I sent another email explaining I would be grateful if could be settled out of court and how sorry I am, does it normally take this long ?

Not enough information here to give you a full response. I'd suggest you have a read of this thread which will advise you on what you need to post to get the best information in response. Also, as you have received a letter, please post it here with all personal details and reference numbers redacted.

As for the response time, they have six months to prosecute (i.e., take you to court), so you may be waiting up to that long to hear from them.

Given this is your second offence, then it may be that the process taken is different, maybe reviewed at a higher level to determine whether to accept your apology or prosecute? (Pure speculation I would say.)

I agree that this is probably the case.

Chiltern's Revenue Enforcement & Prosecutions Policy says:

8.1 Chiltern Railways will have regard to the following factors in favour of prosecution:
a) The offender has a previous conviction for a relevant offence or where the offender has committed a similar offence on Chiltern Railways, any of TfL or Train Operating Company services. b) The offender has previously been issued a Penalty Fare on Chiltern Railways, any of TfL or Train Operating Company services.
