Is he restricted as a result of the WCRC stop short incident, or was he restricted on GWR already?

From what I've seen, I don't think it's said exactly what the restriction is - are people adding 2 plus 2 and coming up with 5?

He's restricted from driving by a TOC. It would seem stupid for a company that is clinging onto its right to operate on the mainline by the skin of its teeth to let him drive under any circumstances.

They need to be squeaky clean for a long time for ORR to get off their case.

I think they're trying to establish whether he has been restricted because of the WCRC incident, or if it was beforehand, which is significant

Is his restriction a TOC matter, or are restrictions logged/made by some government body (ie- does the restriction roll over to WCRC, and is the driver under any obligation to report his GWR restriction to WCRC?)

Yes it does matter - it doesn't say he's banned from driving. It would appear you (and others) have decided that the restriction, whatever it is, means he shouldn't have been driving. Do you know for sure this is the case? (If you do, then I'm in agreement with you.)

If I was restricted that restriction would be on my licence not my role at a given TOC. As far as I've been told anyway.

What I will say on this point is that perhaps GWR drivers on the cushions should perhaps be a little more circumspect in their discussions about colleagues. What I've just overheard has given me the strong impression that the driver in question was restricted from all driving at GWR.

Now, that's hearsay which has no evidential back up, but I've no reason to disbelieve what I overheard.

And I've no idea whether such restriction prevents a driver from 'hobby' driving for a charter operator.

Not usually one to stick up for WCRC, but were they notified if so, by said driver.

I heard that WCRC didn't know the driver was restricted by GWR... Am not sure why he was restricted by GWR but I think he may find himself round the managers table...

Did they need to? This is a general question, not limited to the specific case. If an operator takes on a driver on a part-time basis, one would presume they would need to check that (s)he's qualified and fit to drive.

Having done so, is there any requirement for them to ask on a regular basis if they have had any restrictions placed on their ticket, or is the onus on the driver to inform them?

I must admit I was thinking in terms of taking on a new (to them) driver.

Surely there is an onus on the driver - I presume a both a contractual requirement and part of his legal duty as a/the person responsible for operating the vehicle safely for the driver to report that he has condition xyz that may impact his ability to operate.

That's what I thought, but I don't know the rules.

While WCRC has its failings, if one of their drivers doesn't tell them about a restriction then how are they to know?

If a driver is stopped from driving by his employer does it follow that he cannot drive for another employer privately?

I know commercial pilots have to watch their hours so that private flying say as an instructor or examiner does not intrude on their maximum hours flying per month

But if the second operator did know about the condition and a medical was carried out by them confirming that he was fit to drive that operators trains, then that would be an interesting (if highly unsatisfactory) situation!

It may be that the driver has driven for WCRC previously, if not on a regular basis and had been "vetted" and OK and that when placed on restriction by GWR failed to update WCRC.

Lets just say this isn't social media! And medically if you can't drive silver trains then you can't drive blue or green ones either.....
