It is stated on the WNXX Forum that the Driver ... IS CURRENTLY RESTRICTED FROM DRIVING.
From what I've seen, I don't think it's said exactly what the restriction is - are people adding 2 plus 2 and coming up with 5?
TBH does it matter what the restriction is?
He's restricted from driving by a TOC. It would seem stupid for a company that is clinging onto its right to operate on the mainline by the skin of its teeth to let him drive under any circumstances.
They need to be squeaky clean for a long time for ORR to get off their case.

Yes it does matter - it doesn't say he's banned from driving. It would appear you (and others) have decided that the restriction, whatever it is, means he shouldn't have been driving. Do you know for sure this is the case? (If you do, then I'm in agreement with you.)
What I will say on this point is that perhaps GWR drivers on the cushions should perhaps be a little more circumspect in their discussions about colleagues. What I've just overheard has given me the strong impression that the driver in question was restricted from all driving at GWR.
Now, that's hearsay which has no evidential back up, but I've no reason to disbelieve what I overheard.
And I've no idea whether such restriction prevents a driver from 'hobby' driving for a charter operator.

That's what I thought, but I don't know the rules.Surely there is an onus on the driver - I presume a both a contractual requirement and part of his legal duty as a/the person responsible for operating the vehicle safely for the driver to report that he has condition xyz that may impact his ability to operate.
